1. Acceptance of Terms

By downloading, installing, or using the MotoTagz mobile application ("MotoTagz" or "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. MotoTagz LLC ("we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

MotoTagz is a motorcycle crash detection and emergency response application designed to enhance rider safety. The App provides the following features:

• Automatic crash detection using smartphone sensors
• Emergency contact notification in the event of a detected crash
• Location sharing with emergency services and designated contacts
• Community network features for connecting with other riders
• Route sharing and group ride coordination

3. User Accounts and Registration

To use MotoTagz, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. By using MotoTagz, you represent and warrant that you meet this requirement.

4. Emergency Contacts and Notification

MotoTagz allows you to designate emergency contacts who will be notified in the event of a detected crash. You understand and agree that:

• Emergency contacts will receive your location and crash information
• We may also notify emergency services (911 or local authorities) in certain circumstances
• You are responsible for obtaining consent from your emergency contacts to receive such notifications
• Crash detection relies on smartphone sensors and may not detect all accidents
• You should always call emergency services directly when possible

5. Subscription and Payment

MotoTagz offers both free and premium subscription plans. Premium features require a paid subscription:

• Monthly subscription: $9.99/month
• Annual subscription: $99.99/year (equivalent to $8.33/month)
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your account settings
• Refunds are available within 30 days of purchase

6. Community Guidelines

When using MotoTagz community features, you agree to abide by our community guidelines:

• Treat all community members with respect and courtesy
• Do not post harmful, offensive, or illegal content
• Do not spam or engage in unsolicited advertising
• Do not impersonate others or create false identities
• Do not share routes that trespass on private property
• Report any suspicious or inappropriate behavior

We reserve the right to suspend or terminate your access to community features for violating these guidelines.

7. Privacy and Data Usage

Your privacy is important to us. MotoTagz collects and uses data as described in our Privacy Policy. By using MotoTagz, you consent to:

• Collection of location data to provide crash detection services
• Sharing your location with emergency contacts when a crash is detected
• Collection of ride data to improve App functionality
• Use of anonymized data for research and analytics

8. Disclaimer of Warranties

MOTO TAGZ IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. CRASH DETECTION RELIES ON SMARTPHONE SENSORS AND MAY NOT DETECT ALL ACCIDENTS OR MAY PRODUCEFALSE POSITIVES. YOU UNDERSTAND THAT MOTO TAGZ IS NOT A REPLACEMENT FOR PROFESSIONAL EMERGENCY SERVICES. IN THE EVENT OF AN EMERGENCY, ALWAYS CALL 911 OR YOUR LOCAL EMERGENCY SERVICES DIRECTLY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTO TAGZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless MotoTagz LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including:

• Violation of these Terms
• fraudulent or illegal activity
• Non-payment of subscription fees
• Request for deletion by you

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Fulton County, Georgia.
